Trustees are appointed by the court to manage either an arrangement between the borrower and the creditors, or the liquidation of the assets of the company. We can get involved in a global restructuring of the company, and can make cash offers to each class of creditors, to allow the company to emerge from bankruptcy. We can also buy specific claims, as opposed to the whole class. Our intervention in the early stages of bankruptcy can allow for the greatest possible realization of the assets of the company since creditors would have the advantage of receiving from us a going-concern value rather than a liquidation value.
